Westport Plastic Surgeon Again Cited By DPH | Connecticut ...

A Westport plastic surgeon who is on probation and was fined $29,000 last year faces further sanctions following unannounced inspections of his center that found additional violations for lax management of nursing care, sanitation and infection control.

When an inspector from the state Department of Public Health visited Imperial Plastic Surgery for three days in March, the inspector found several violations, including unqualified nurses, slipshod record keeping, improper sterilization procedures and unsanitary conditions, such as an open bag of trash and an open container of soiled linens. These and other violations were delineated in a 58-page, Aug. 29 consent order signed by Dr. Joel B. Singer, the sole owner of the facility, which also operates under the name: Center for Ambulatory Surgery.

Singer says these most recent charges are ?all part of an ongoing compliance matter. It?s all part of the same thing. Each time they come, they inspect, they find something else,? he said this week. ?I?m sure if they came today, they?d find something.?

But the most recent inspection uncovered new violations. For example, a nurse told the investigator that she was the nursing supervisor, even though she had only started working at the center the day before. This nurse had graduated from nursing school 10 months earlier and lacked the training and experience necessary for that position, the consent order says.

In addition, a review of the clinical records revealed that the facility failed to ensure an accurate and complete clinical record for 13 of the 13 surgical patients whose cases were reviewed, according to the consent order. For example, there was no written record indicating whether most of those patients had received written discharge instructions that typically explain what to expect following surgery and what symptoms constitute complications.

Since then, Singer said, he has taken steps to address the concerns raised by state inspectors. ?I have three full-time nurses,? he said. ?That?s all in the past. That?s not true anymore. That was taken care of. ?Pretty much what it amounts to now are regulatory compliance issues.?

Over the past several years, the state health department has cited Singer for multiple violations against his physician?s license and against his surgery center. Singer has two businesses licensed with the Secretary of State?s office ? Imperial Plastic Surgery and the Center for Ambulatory Surgery. The former is the name for his practice and the latter is the name for the surgery facility, he said. For the past year, Singer also has owned and operated Imperial Plastic Surgery in Great Neck, N.Y.

The health department cited the Center for Ambulatory Surgery in May 2011 and imposed a $4,000 fine, a $25,000 civil penalty, a reprimand and two years? probation. His facility license was suspended and the center remained closed for three months while he implemented state-mandated changes. That consent order was approved by the state Medical Examining Board in December 2011.

Singer, who graduated from Yale University medical school in 1966, has three prior Connecticut health department actions against his physician?s license. In a May 2007 consent order, the state health department fined him $5,000 for a case of ?incompetence/negligence.? He admitted to lapses in documenting post-surgical conversations between himself and a patient after complications developed following her breast reduction surgery.? That patient required a second operation after failing to heal properly.

In a July 1999 consent order, Singer agreed to be placed on one year?s probation for inserting implants of difference sizes into a patient during breast augmentation surgery. The patient record was altered to read that the implants were the same size, the consent order says.
Following the unannounced inspections in March, conducted to see whether Singer and his facility were complying with terms of his probation, the health department issued an amended consent order. Singer has agreed to hire, at his expense, a health department-approved clinical consulting firm that has expertise in outpatient surgical centers.

The consent order outlines a detailed list of 14 systems that must be monitored and reviewed by the clinical consulting firm, pertaining to: controlling infection; medical documentation; nurse staffing, credentialing and supervision; physician and APRN credentialing; quality assessment; surgical services; medication storage; management; quality assessment and performance improvement; and matters pertaining to sterilization of instruments and the operating room.

The clinical consultant has to spend at least four hours a month at the Imperial Avenue plastic surgery center directly observing the staff?s performance and reviewing the staff?s credentials to be sure that they?re in compliance with federal laws. The consent order requires that the surgery center?s administrator and medical director meet quarterly with the health department during the period of the consent order.

Singer also has a license to practice medicine in New York and California. Because of the disciplinary actions and fines he?s received on his Connecticut license, both California and New York states have issued public reprimands.

New York?s health department issued censures and reprimands in 2000, 2007 and on Sept. 21, levying fines in the amount of $1,000, $5,000 and $1,000, respectively. California?s medical board issued public reprimands in 2000 and 2009. Awaiting a hearing before the California medical board is a petition by the California health department to revoke, suspend or place on probation Singer?s license to practice in California, based on Connecticut?s medical board sanctions on his and his facility?s licenses.

NEW YORK (AP) ? Iranian President Mahmoud Ahmadinejad said Tuesday that a new world order needs to emerge, away from years of what he called American bullying and domination.

Ahmadinejad spoke to The Associated Press in a wide-ranging interview on the sidelines of the U.N. General Assembly ? his last as president of Iran. He was to address the Assembly Wednesday morning.

He also discussed solutions for the Syrian civil war, dismissed the question of Iran's nuclear ambition and claimed that despite Western sanctions his country is better off than it was when he took office in 2005.

"God willing, a new order will come together and we'll do away with everything that distances us," Ahmadinejad said, speaking through a translator. "I do believe the system of empires has reached the end of the road. The world can no longer see an emperor commanding it."

"Now even elementary school kids throughout the world have understood that the United States government is following an international policy of bullying," he said.

President Barack Obama warned Iran earlier Tuesday that time is running out to resolve the dispute over its nuclear program. In a speech to the General Assembly, Obama said the United States could not tolerate an Iran with atomic weapons.

Ahmadinejad would not respond directly to the president's remarks, saying he did not want to influence the U.S. presidential election in November.

But he argued that the international outcry over Iran's nuclear enrichment program was just an excuse by the West to dominate his country. He claimed that the United States has never accepted Iran's choice of government after the 1979 Islamic revolution.

"Everyone is aware the nuclear issue is the imposition of the will of the United States," he said. "I see the nuclear issue as a non-issue. It has become a form of one-upmanship."

Ahmadinejad said he favored more dialogue, even though negotiations with world powers remain stalled after three rounds of high-level meetings since April.

He said some world leaders have suggested to him that Iran would be better off holding nuclear talks only with the United States.

"Of course I am not dismissing such talks," he said, asked if he were open to discussions with the winner of the American presidential election.

Israeli leaders, however, are still openly contemplating military action again Iranian nuclear facilities, dismissing diplomacy as a dead end. Israel and many in the West suspect that Iran is seeking to acquire nuclear weapons, and cite its failure to cooperate fully with nuclear inspectors. Iran says its nuclear program is for peaceful purposes only.

Ahmadinejad also proposed forming a new group of 10 or 11 countries to work to end the 18-month Syrian civil war. Representatives of the nations in the Middle East and elsewhere would meet in New York "very soon," he said.

Critics have accused Tehran of giving support to Syrian President Bashar Assad in carrying out massacres and other human rights violations in an attempt to crush the uprising against his rule. Activists say nearly 30,000 people have died.

He said the so-called contact group hopes to get the Syrian government and opposition to sit across from each other.

"I will do everything in my power to create stability, peace and understanding in Syria," Ahmadinejad said.

Earlier this month, Egyptian President Mohammed Morsi announced the formation of a four-member contact group with Iran, Turkey and Saudi Arabia. But Saudi Arabia so far has not participated.

He denied Iranian involvement in plotting attacks on Israelis abroad, despite arrests and accusations by police in various countries. He also vehemently disputed the U.S. claim that Iranian agents played a role in a foiled plot to assassinate the Saudi ambassador to the United States last year.

Ahmadinejad will leave office next June after serving two four-year terms. He threw out numbers and statistics during the interview to show that Iran's economy and the lives of average Iranians have improved under his watch. Since his 2005 election, he claimed, Iran went from being the world's 22nd-largest economy to the 17th-largest; non-petroleum related exports increased sevenfold; and the basic production of goods has doubled. Median income increased by $4,000, he said.

"Today's conditions in Iran are completely different to where they were seven years ago in the economy, in technical achievement, in scientific know-how," Ahmadinejad said. "All of these achievements, though, have been reached under conditions in which we were brought under heavy sanctions."

Iran has called for the U.S. and its European allies to ease the sanctions that have hit its critical oil exports and left it blackballed from key international banking networks.

Ahmadinejad said he had no knowledge of the whereabouts of Robert Levinson, a private investigator and former FBI agent who vanished in Iran five years ago. He said he directed Iranian intelligence services two years ago to work with their counterparts in the U.S. to locate him.

"And if any help there is that I can bring to bear, I would be happy to do so," he said.

He also claimed never to have heard of Amir Hekmati, a former U.S. Marine who is imprisoned on espionage charges in Iran. Hekmati was arrested while visiting his grandmother in Iran in August 2011, and his family has been using Ahmadinejad's visit to New York to plead for his release.

salt to taste (optional)

2 Tbsp (30 mL) freshly squeezed lemon juice

METHOD

Place all the ingredients, except for the water, in a liquidizer, and, adding a little water at a time, process until smooth. The consistency should be like that of a thousand island dressing ? use your own judgment in terms of how much water to add ? you may need a little less, or a little more, depending on your personal preference.

Well, it took a while, but Google has finally launched the Nexus 7 in Japan. Futures flat as Fed hopes offset Caterpillar

NEW YORK (Reuters) - U.S. stock index futures were little changed on Tuesday as a pessimistic outlook from Caterpillar Inc. , the latest U.S. heavyweight to say the slowing global economy was hurting profits, was offset by hopes of more monetary stimulus.

* Equities have rallied in recent months on expectations for stimulus from central banks around the world, and announcements of easing earlier this month from the Federal Reserve and European Central Bank have kept the S&P 500 near multi-year highs.

* San Francisco Fed president John Williams said on Monday he expected the central bank to expand its bond-buying program next year to more aggressively combat the unemployment rate. He also expects the program to end before the close of 2014.

* Just minutes before markets closed on Monday, Caterpillar Inc cut its 2015 profit outlook, warning that weaker commodity prices would result in a bigger-than-expected fall-off in demand. Thee Dow component, however, stopped short of forecasting a global recession. Shares fell 2.2 percent to $88.87 in premarket trading.

* While central bank actions have kept equity gains largely intact, recent corporate outlooks have given investors a reason to be cautious about future growth. FedEx Corp and Norfolk Southern were among the companies that lowered their forecasts recently.

* S&P 500 futures fell 0.4 point but remained above fair value, a formula that evaluates pricing by taking into account interest rates, dividends and time to expiration on the contract. Dow Jones industrial average futures added 5 points and Nasdaq 100 futures fell 0.5 point.

* The S&P 500 is on track for a 7.6 percent gain for the quarter, a rally largely tied to central banks' actions to stimulate their economies. After those gains, many market participants are looking for new catalysts to keep pushing shares higher.

* Analysts said investors are probably now participating in "window dressing," where fund managers add some of the latest outperformers to their portfolio.

* Paychex Inc reported a first-quarter profit that narrowly beat estimates, helped by higher revenue from its human resource services business.

* Red Hat Inc reported a lower-than-expected adjusted profit as costs rose, and lowered the top end of its full-year revenue outlook on slow growth in its services business.

* U.S. stocks closed flat on Monday as an index of German business sentiment declined for a fifth consecutive month in September, showing Europe's strongest economy was moving closer toward recession as the euro zone's debt crisis remains unresolved. Caterpillar's outlook further pressured sentiment going into the close.
