Symantec updates its scary (but wrong) Counterclank 'malware' claims

Symantec

Symantec has "adjusted" its statement to Computer World that as many as 5 million Android users may be affected by the latest bit of malware, coming to the conclusion that the applications in question are simply using an aggressive ad network SDK.  This mirrors the statement issued by Lookout, as well as our own.  (And as well as Computer World's Android Power faction.)

After initially telling users that the "malicious code" found in 13 Android Market applications was malware and capable of data theft and other nefarious activity, Symantec now says the apps in question are more akin to Windows adware and not inherently malicious.  

In other words, it's crapware.  This we can all agree with.  The apps in question use an advertisement SDK that allows things none of us likes -- it can add bookmarks, change your homepage, add shortcuts to the home screen and the like.  We've all installed some free Windows program from the web, and had it install (or try to install) browser toolbars, add shortcuts to the home screen for more spammy programs.  We all hated it then, and we hate it now.  What we hate even more is when a company that claims to be acting in the interest of our security jumps the gun and labels these types of programs the same way it would label a bot or trojan.  

We're mostly informed users here, and quickly realize the difference.  But how many of those who stumbled across websites parroting Symantec's cries of five million infected are as Android savvy as we are?  There's a good chance that it's not that many.  Instead those readers were left confused and concerned that they had been "hacked."

We hope that the rest of the web that followed along will update their stories with today's news. And more important -- we hope that app developers stay far away from this sort of thing. Lord knows we're going to stay away from them if they don't.

NHL All Star Game 2012: Team Chara Beats Team Alfredsson 12-9

OTTAWA ? Marian Gaborik made New York Rangers teammate Henrik Lundqvist pay for not selecting him to play for Daniel Alfredsson's team in the NHL All-Star game.

Gaborik beat Lundqvist twice in the first period, finished with three goals and an assist, and earned MVP honors in leading Team Chara to a 12-9 win over Team Alfredsson on Sunday.

Tim Thomas made 18 saves in the final period, and extended his record by winning his fourth All-Star game.

Chara, with the eventual winning goal, Marian Hossa and Corey Perry broke the game open by scoring three times in a span of 1:22 that put their club ahead 11-8 with 6:34 remaining.

Despite the loss, Alfredsson rewarded his hometown fans by leading his team with two goals and an assist. The Senators captain also hinted afterward that he is considering coming back for one more season.

In an interview broadcast on the arena's scoreboard, Alfredsson was asked about his future.

With a smile on his face, and fans cheering his name, Alfredsson said: "Fifty percent yes, and my wife's going to have to decide the other 50."

Henrik Sedin had a goal and two assists for Team Alfredsson.

Gaborik became the 16th player to score at least three goals ? one short of matching the record ? in the All-Star game, and first since Rick Nash had three in 2008.

The outcome was decided in the final period, in which Team Chara outscored Team Alfredsson 6-3.

Hossa broke an 8-8 tie by scoring on a partial breakaway after being set up by Pavel Datsyuk with 7:56 left. Settling the puck, Hossa stopped in front and then backhanded a shot past Brian Elliott.

Chara gave his club a 10-8 lead when Gaborik fed him a perfect pass into the middle for a snap shot past Elliott.

For Team Chara, Hossa and Jarome Iginla had a goal and two assists, and Joffrey Lupul scored twice.

Daniel Sedin, John Tavares, Jason Pominville and Milan Michalek had a goal and assist each for Team Alfredsson.

Team Chara got off to a fast start, building a 3-0 lead on Gaborik's second goal 9:51 in. The club was so dominant that it was leading 2-0 before Alfredsson's team got off its first shot.

Gaborik certainly enjoyed getting the best of Lundqvist. After scoring his first goal on a give-and-go with Datsyuk, Gaborik circled the net dropped to one knee and pointed his stick at Lundqvist while pumping his fist.

Lundqvist jokingly lamented about being beaten three times on eight shots, including twice by his Rangers teammate.

"There's been a lot of trash talk, but it feels like it's game over already," said Lundqvist, who was wearing a microphone during the opening period.

Lundqvist was Alfredsson's assistant captain, and had a hand in the team's drafting philosophy on Thursday.

Team Alfredsson rallied to tie the game at 3 before the first period was over. But they didn't get their first ? and only lead ? until Alfredsson scored twice during a 1:31 span to put his team up 6-5 with just under four minutes left in the second.

His first goal came on a great individual effort in which Alfredsson, dragging the puck behind him, split defensemen Kimmo Timonen and Ryan Suter, and flipped a shot that sneaked inside the right post to beat goalie Carey Price.

Alfredsson's second goal came on a wonderful passing play courtesy of Daniel and Henrik Sedin, whom Alfredsson was looking forward to play with when he drafted the twins. Henrik Sedin drove up the left wing, fed a pass through the crease to his twin brother, who then redirected to the high slot, where Alfredsson slapped it home.

Price allowed three goals on 14 shots, and had lamented the All-Star game's lack of defense during the first intermission.

"I feel like being a lamb getting led to slaughter," Price said. "I'm must be holding on for the ride today and hope I don't get lit up too bad."

The game was missing the NHL's most high-profile stars in Sidney Crosby and Alex Ovechkin. Crosby has been limited to playing just eight games this season as a result of a concussion, and has also been diagnosed with a neck injury, making it unclear when or if he will play at all this season.

Ovechkin backed out last week after the NHL suspended him three games for an illegal hit.

The game featured 17 first-time All-Stars, 10 playing on Team Alfredsson. Team Chara's roster had the edge over Team Alfredsson in combined games played (10,227-8,425, not including goalies), career goals (2,850-2,286) and career points (7,394-6,164).

Steven Stamkos was awarded a penalty shot with 3:27 left in the first period after he was tripped up by Dion Phaneuf.

On the penalty shot, Stamkos ? who leads the NHL with 32 goals ? attempted the same spin-around move he used to beat Price in the skills competition on Saturday night. Howard didn't bite on Sunday, holding his ground and hugging the post to stop Stamkos' attempt.

It was the second penalty shot taken in an All-Star game. The other was last year in at Raleigh, N.C., when Colorado's Matt Duchene was stopped by Lundqvist.

Sudan rebels say holding 29 Chinese workers (Reuters)

KHARTOUM (Reuters) ? Rebels in Sudan's oil-producing border state of South Kordofan said on Sunday they were holding Chinese workers for their own safety after a battle with the Sudanese army.

The army has been fighting rebels of the SPLM-N in South Kordofan bordering newly independent South Sudan since June. Fighting spread to the northern Blue Nile state in September.

"We are holding 29 Chinese workers after a battle with the army yesterday," a spokesman for the SPLM-N said. "They are in good health. We are holding them for their own safety because the army was trying to strike again."

The army said rebels had attacked the compound of a Chinese construction company operating in the area between the towns of Abbasiya and Rashad in the north of the state and captured 70 civilians.

"Most of them are Chinese. They (the rebels) are targeting civilians," said army spokesman Sawarmi Khalid Saad.

He said there had been no battle in the area and the army was now trying to rescue the civilians.

China's foreign ministry urged Sudan to guarantee the safety of Chinese personnel during the search and rescue process, according to a statement released in Beijing.

South Kordofan is the main oil-producing state in Sudan, while Blue Nile is rich in minerals such as chrome.

The fighting in both states has forced about 417,000 people to flee their homes, more than 80,000 of them to South Sudan, according to the United Nations.

Both states contain large groups who sided with the south in a decades-long civil war, and who say they continue to face persecution inside Sudan since South Sudan seceded in July.

The SPLM is now the ruling party in the independent south and denies supporting SPLM-North rebels across the border.

Events in South Kordofan and Blue Nile are difficult to verify because aid groups and diplomats are banned from areas where fighting takes place.

SPLM-North is one of a number of rebel movements in underdeveloped border areas who say they are fighting to overthrow Sudanese President Omar Hassan al-Bashir and end what they see as the dominance of the Khartoum political elite.

Sudan and South Sudan, which still have to resolve a range of issues including the sharing of oil revenues, regularly trade accusations of supporting insurgencies on each other's territory.

Davis, Dujardin win lead honors at SAG awards (AP)

LOS ANGELES ? Viola Davis and Octavia Spencer were the maids of honor at Sunday's Screen Actors Guild Awards, where their Deep South drama "The Help" won them acting prizes and earned the trophy for overall cast performance.

Davis won as best actress and Spencer as supporting actress for "The Help," while Jean Dujardin was named best actor for the silent film "The Artist" and Christopher Plummer took the supporting-actor award for the father-son tale "Beginners."

The wins boost the actors' prospects for the same honors at the Feb. 26 Academy Awards.

In "The Help," Davis and Spencer play black maids going public with uneasy truths about their white employers in 1960s Mississippi.

"I just have to say that the stain of racism and sexism is not just for people of color or women. It's all of our burden, all of us," Davis said, accepting the ensemble prize on behalf of her "The Help" co-stars.

Accepting her best-actress award, Davis singled out two performers in the audience who inspired her early in her career: "The Help" co-star Cicely Tyson and Meryl Streep, Davis' co-star in the 2008 drama "Doubt" and one of the nominees she beat out for the SAG prize. Streep had been nominated as Margaret Thatcher in "The Iron Lady," a role that won her the dramatic actress award at the Golden Globes over Davis.

A French film star who is a newcomer to Hollywood's awards scene with "The Artist," Dujardin played a silent-era screen idol fallen on hard times as talking pictures take over in the late 1920s.

"I was a very bad student. I didn't listen in class. I was always dreaming," Dujardin said. "My teachers called me `Jean of the Moon,' and I realize now that I never stopped dreaming. Thank you very much. Thank you for this dream."

Plummer would become the oldest actor ever to win an Oscar at age 82, two years older than Jessica Tandy when she won best actress for "Driving Miss Daisy."

Backstage, Plummer joked when asked if he would like to win an Oscar, an honor so elusive during his esteemed 60-year career that he did not even receive his first Academy Award nomination until two years ago, for "The Last Station."

"No, I think it's frightfully boring," Plummer said. "That's an awful question. Listen, we don't go into this business preoccupied by awards. If we did, we wouldn't last five minutes."

Spencer, a veteran actress who had toiled in small TV and movie parts previously, had a breakout role in "The Help" as a brassy maid whose mouth continually gets her in trouble.

"I'm going to dedicate this to the downtrodden, the under-served, the underprivileged, overtaxed ? whether emotionally, physically or financially," Spencer said.

On the television side, comedy series awards went to "Modern Family" for best ensemble; Alec Baldwin as best actor for "30 Rock"; and Betty White as best actress for "Hot in Cleveland."

"You can't name me, without naming those other wonderful women on `Hot in Cleveland,'" the 90-year-old White said. "This nomination belongs to four of us. Please, please know that I'm dealing them right in with this. I'm not going to let them keep this, but I'll let them see it."

The TV drama show winners were: Jessica Lange as best actress for "American Horror Story"; and Steve Buscemi as best actor for "Boardwalk Empire," which also won the ensemble prize.

For TV movie or miniseries, Kate Winslet won as best actress for "Mildred Pierce," while Paul Giamatti was named best actor for "Too Big to Fail."

Before the official ceremony, the Screen Actors Guild presented its honor for best film stunt ensemble to "Harry Potter and the Deathly Hallows: Part 2." The TV stunt award went to "Game of Thrones."

The winners at the SAG ceremony often go on to earn Oscars. All four acting recipients at SAG last year later took home Oscars ? Colin Firth for "The King's Speech," Natalie Portman for "Black Swan" and Christian Bale and Melissa Leo for "The Fighter."

The same generally holds true for the weekend's other big Hollywood honors, the Directors Guild of America Awards, where Michel Hazanavicius won the feature-film prize Saturday for "The Artist." The Directors Guild winner has gone on to earn the best-director Oscar 57 times in the 63-year history of the union's awards show.

The guild's ensemble prize, considered the ceremony's equivalent of a best-picture honor, has a spotty record at predicting what will win the top award at the Oscars.

While "The King's Speech" won both honors a year ago, the SAG ensemble recipient has gone on to claim the top Oscar only eight times in the 16 years since the guild added the category.

Though "The Help" won the ensemble prize this time, "The Artist" and George Clooney's family drama "The Descendants" are considered stronger contenders for the best-picture Oscar.

Both "The Artist" and "The Descendants" also were nominated for writing and directing Oscars, categories where serious best-picture candidates generally need to be in the running. "The Help" missed out on nominations in both of those Oscar categories.

Mary Tyler Moore received the guild's lifetime-achievement award, an honor presented to her by Dick Van Dyke, her co-star on the 1960s sit-com "The Dick Van Dyke Show."

SAG President Ken Howard put in a plug during the show for the guild's planned merger with another Hollywood union, the American Federation of Television and Radio Artists. The boards of both groups have approved the merger, and ballots will be sent to members of each union.

"As one union, SAG-AFTRA will support a future of great entertainment for all of us," Howard said.

Information from Australian PM's aide led to clash (AP)

CANBERRA, Australia ? A clash between protesters and Australian police that forced bodyguards to rush Prime Minister Julia Gillard out of an event appears to have been set off by information released by one of Gillard's own aides.

The aide, media adviser Tony Hodges, resigned. Gillard's office said Friday that he told someone that opposition leader Tony Abbott would be at the awards ceremony where the clash occurred. A spokesperson said in a statement that the information was passed on to indigenous-rights protesters who were demonstrating nearby.

The protesters were angry about comments Abbott made about their movement, and about 200 of them surrounded the Canberra restaurant where the ceremony was being held. Gillard stumbled as she was rushed out and lost a shoe, which the protesters picked up.

Gillard said Saturday that Hodges acted alone, and that she accepted his resignation because she considered his conduct unacceptable. She said she was upset that protesters disrupted the awards ceremony, which honored Australians for their service and courage during recent natural disasters.

Abbott on Saturday demanded more details and an investigation into what he called a "serious security breach." He told Sky News the incident appeared to be an attempt to "trigger something potentially dire for political advantage."

"Trouble was triggered and it seems that someone from the prime minister's office had a very big hand in all of that," he said.

Gillard said the suggestion that she played a role in the clash was "deeply offensive" and added that "it is absolutely typical of Mr Abbott's negativity and his tendency to go too far."

The restaurant where Thursday's clash occurred is close to the so-called Aboriginal Tent Embassy, where the protesters had demonstrated peacefully earlier in the day. That long-standing, ramshackle collection of tents and temporary shelters is a center point of protests against Australia Day, which marks the arrival of the first fleet of British colonists in Sydney on Jan. 26, 1788.

The Tent Embassy celebrated its 40th anniversary on Thursday, and Abbott had earlier angered activists by saying it was time the embassy "moved on." Abbott said Friday that his comment had been misinterpreted, and that he never meant to imply the embassy should be torn down.

Microsoft paid Nokia $250 million to adopt Windows Phone, Q4 earnings report reveals

Microsoft and Nokia have historically been pretty tight-lipped about the value of their Windows Phone partnership, but the cat leapt out of the bag this morning, courtesy of Espoo's Q4 2011 earnings report. As SlashGear's Chris Davies noticed, Nokia received about $250 million from Redmond during the fourth quarter of 2011, as part of the companies' "broad strategic agreement." Under the agreement, the manufacturer receives so-called "platform support payments" from Microsoft -- which, in turn, receives software licensing payments from Nokia. The $250 million Microsoft doled out last quarter is the first of these transactions. All told, Nokia expects the payments both to and from Microsoft to total "in the billions of US Dollars."

This is announcement is unique because it does not list their academic credentials, their previous investments, the boards of companies or non-profits they have sat on, how many years of experience they have, or any of the usual badges of honor investors parade in their biographies and Crunchbase profiles.

Instead we get accolades of ?rare individuals who can both design and program? and ?best hackers among the YC alumni.? Take note of this moment.

I was part of a dinner conversation the other night that included institutional and angel investors, entrepreneurs, and someone who was part of the YC program. The group circled with alarming intent on grilling the YC entrepreneur: ?How much time did you actually get with PG?? ?It?s a cult of personality.? ?The average quality of the companies has really dropped as they?ve broadened.? ?I can?t wait for this bubble to pop.? I believe it was mostly in jest ? few topics were spared that night ? but there was some truth in the defensive undertone.

The hackers and engineers of Y Combinator are doing what hackers and engineers do to any industry, they?re efficiently and ruthlessly disrupting the traditional model of venture capital and are going to destroy far more more wealth for their contemporaries than they create for themselves, as broadband did to entertainment, Craigslist did to newspapers, and Amazon did to traditional retailers. This is what outsiders, by definition, do.

The dark humor in this is that the same people who delight and celebrate investing in disrupting other industries are blind or in denial about it happening to their own.

The question then becomes if you?re an investor with a traditional LP model (and expectations), or a more financial background than an operational one, or an operational background more in management than in design or coding, what should you do to stay relevant through this shift?

(AP) ? Kris Joseph scored 17 points Monday night, and No. 3 Syracuse recovered from its first loss of the season by beating Cincinnati 60-53, giving coach Jim Boeheim a notable career win.

The Orange (21-1, 8-1 Big East) used a late 12-2 run to pull away from the Bearcats (15-6, 5-3), who tried to use the energy of their first home sellout to get a signature win.

Instead, Boeheim came away with career victory No. 877, moving him ahead of Adolph Rupp into sole possession of fourth place on the Division I coaching list.

Syracuse was coming off a 67-58 loss at Notre Dame on Saturday that ended the best start in school history and cost the Orange their No. 1 ranking. Joseph had three driving baskets during the 12-2 run midway through the second half.

Cashmere Wright had 17 points for Cincinnati, which suffered its first back-to-back losses of the season.

A little old-fashioned zone defense made the difference. Cincinnati's 53 points matched its season low against Xavier.

The Bearcats, who wore throwback uniforms for their biggest home game of the season. Most of the 13,176 fans dressed in white, and the coaches wore white button-down shirts without jackets. Syracuse's late spurt sent them to the exits before the buzzer.

The Orange was missing 7-foot center Fab Melo for the second straight game. Melo is their top rebounder and shot blocker. The school hasn't disclosed the reason for his absence.

Syracuse leads the Big East with 78.9 points per game and 48 percent shooting, fueled by fastbreak layups off turnovers. Cincinnati kept it close until the late Orange run.

The Bearcats fed off the crowd's energy and made four of their first five shots from behind the arc, including three long 3s by Wright, for a 15-6 lead. They went cold after that and had trouble scoring inside Syracuse's zone defense.

C.J. Fair had a fastbreak dunk and a baseline jumper during a 9-0 run that tied it at 15. Both defenses then dug in, keeping it close the rest of the half.

Syracuse never led during its loss at Notre Dame, unable to overcome a slow start. The Orange got their first lead Monday in the final minute of the half. Joseph had a driving dunk ? he went past two Bearcats on the baseline ? and Dion Waiters hit a pull-up jumper with a second left for a 28-25 halftime lead.

Cincinnati went inside to power forward Yancy Gates at the start of the second half and got a lot of open shots. The power forward had three layups and a 15-foot jumper, scoring eight of the Bearcats' first 13 points in the half.

Gates had his best offensive game since returning from a six-game suspension for a brawl against Xavier, scoring 16 points.

Syracuse finally found its touch from behind the arc. Scoop Jardine hit a 3 with 9:30 left ? the Orange had been 0 for 8 ? and Brandon Triche followed with another during the 12-2 run that gave the Orange their biggest lead at 52-44 with 6:08 to go.

Another 3 by Jardine pushed it to 59-48 with 1:52 left, sending the white-shirted fans to the exits.

Through the Looking Glass - Dedicated Players Wanted

Hello, everyone! I've worked with two friends of mine to create the roleplay Through the Looking Glass, a story that follows the adventures of fairy tale characters in the real world and real world people in a fantasy world. Now, we know that it has similarities to the television show Once Upon a Time, but we want to establish that we're trying to go a very different direction with our story.

In this roleplay, everyone will have two characters: A fairy tale character and their real-world counterpart, who will switch universes at the very beginning of the RP. From there, they can either begin to make their way back, or try to make themselves at home in the real world. All this takes place during a time of political upheaval between the good and evil queens of Atleos, and a corporate legal conflict in modern-day New York.

We are trying to limit the use of 'well-known' characters, such as Disney Princesses and Princes, and choose more unusual and 'minor' characters from existing fairy tales to allow for as much creative room as we want, while still allowing for some fun name-dropping and references to other stories.

Complication in first triple limb transplant (AP)

ANKARA, Turkey ? A Turkish doctor whose 25-member team performed the world's first triple limb transplant ? two arms and a leg ? says the leg has been removed due to tissue incompatibility.

Dr. Omer Ozkan says 34-year-old Atilla Kavdir is in stable condition after the removal of the leg on Sunday, a day after it was attached. Kavdir lost his arms and right leg when he was 11 after he hit power lines outside his home with an iron rod to scare away pigeons and received an electric shock.

Ozkan said another patient who received a full face transplant from the same donor is in stable condition. It was Turkey's first face transplant.

Joe Paterno, revered coach tainted by scandal, dies (Reuters)

STATE COLLEGE, Pennsylvania (Reuters) ? Penn State football coach Joe Paterno, the winningest coach in major college football history who was fired in November over a child sexual abuse scandal involving an assistant that rocked America, died on Sunday of lung cancer. He was 85.

Paterno won adoration from fans of the highly successful and profitable Penn State football program and they unleashed invective at the university board of trustees who fired him unceremoniously after 46 years as head coach, tarnishing his outsized legacy.

Equally outraged were his critics and advocates for victims of sexual abuse who faulted Paterno for his relative inaction upon hearing an accusation that former defensive coordinator Jerry Sandusky had sexually abused a young boy in the Penn State football showers in 2002.

Paterno told university officials but not police, opening him to criticism that he protected an accused child molester for nine years.

Sandusky, 67, who has maintained his innocence, faces 52 criminal counts accusing him of sexually abusing 10 boys over 15 years, using his position as head of a The Second Mile, a charity dedicated to helping troubled children, to find his victims. The court placed him under house arrest.

Waves of mourners descended on a makeshift shrine to Paterno outside the university's Beaver Stadium. They draped an American flag on a statue of Paterno and wrapped its neck with a Penn State scarf.

Sobbing at the statue's feet was Dana Gordon, a 1982 graduate who blamed the school's Board of Trustees for hastening Paterno's death by firing him in a "callous way."

"The way the board treated him took a lot of the fight out of him," Gordon said.

The case raised questions about the measures the university took to protect Sandusky and a football program that Forbes magazine estimated made a profit of $53 million in 2010, especially since accusations against him first surfaced in 1998. At that time a university police detective admonished Sandusky to stop showering naked with boys but stopped short of bringing criminal charges.

One of the biggest scandals in college sports history, it provoked a national discussion about pedophilia in the same way charges involving Roman Catholic priests did years earlier.

The matter also drew impassioned arguments about the balance between protecting the young and the rights of criminal defendants, who are presumed innocent until proven guilty.

"I hope his passing and the controversy surrounding Sandusky will deter other people, especially powerful people, from covering up child sex crimes," said David Clohessy, director of Survivors Network of those Abused by Priests, a support group.

"Even decades of professional achievement should not obscure dreadfully reckless and callous inaction that results in child sex crimes," Clohessy said.

Sandusky issued a statement sending condolences to the Paterno family that did not mention the investigation.

"Nobody did more for the academic reputation of Penn State than Joe Paterno. He maintained a high standard in a very difficult profession," Sandusky said.

Paterno won a reputation for making sure his players graduated and one of the program's mottos was "Success With Honor."

Paterno's downfall was spectacular. For decades he was a symbol of vitality who patrolled the Penn State sidelines with unchallenged authority, easily recognizable by his thick eyeglasses and jet-black hair that only showed a hint of gray in his later years. His two national championships, in 1982 and 1986, won him enduring loyalty from fans who affectionately called him "JoePa."

In the end, he was confined to a wheelchair upon breaking his hip in a fall one month after being fired, and he wore a wig after losing his hair to chemotherapy, according to the Washington Post, which interviewed Paterno about a week before his death.

Paterno was surrounded by family when he died 9:25 a.m. on Sunday of metastatic small cell carcinoma of the lung, Mount Nittany Medical Center said in a statement.

IMPACT ON CRIMINAL CASE

Paterno's death may not significantly affect the case against Sandusky, but was more likely to weaken the criminal case against two university officials charged with perjury, at least one legal expert said.

Paterno learned of at least one accusation against Sandusky in 2002, when graduate assistant Mike McQueary told Paterno he witnessed Sandusky molesting a boy of about 10 years old in the showers of the Lasch Football Building.

Paterno told university officials but not police, a decision that ultimately led to his downfall.

Paterno, in an interview with the Washington Post published on January 14, said he was uncertain how to handle the matter and trusted the university administration.

Paterno testified before the grand jury that he informed former athletic director Tim Curley about what McQueary told him. About 10 days later, McQueary testified, he was called to a meeting with Curley and university finance official Gary Schultz to discuss what happened.

Curley and Schultz both face perjury charges based on their inaction. Schultz also testified before the grand jury he was aware of the 1998 investigation of Sandusky.

University President Graham Spanier was fired along with Paterno, and Curley and Schultz stepped down.

"If he (Paterno) had known the devastation that this means, he would have reacted differently," said Peter Pelullo, founder of Let Go, Let Peace Come In, a support group helping some of Sandusky's accusers with counseling.

"If there had been an auto accident on the Penn State campus and a kid had been run over, everybody would have called 911. That boy was being crushed at the moment he was in the shower with Sandusky. It's not just Joe Paterno but the rest of the country that didn't understand this," Pelullo said.

Because Paterno was not believed to have witnessed any purported abuse, his testimony would not have been crucial to Sandusky trial, said Paul Callan, a former prosecutor and criminal defense attorney.

But his death could set back the criminal case against Curley and Schultz.

"The Confrontation Clause (of the constitution) guarantees that criminal defendants will have the right to confront and cross-examine the witnesses against them at the time of trial," Callan said. "No defense attorneys were present at the grand jury proceedings to do such a cross-examination."

Max Kennerly, a Philadelphia trial lawyer who has followed the case, said Paterno's death was unlikely to alter any civil litigation being contemplated by Sandusky's accusers. If any were considering suing Paterno, they could just name his estate.

"Death doesn't change your status as a party," Kennerly said.

(AP) ? Mark Sanchez is still the New York Jets' quarterback of the future.

Well, at least for now.

Owner Woody Johnson supported his embattled quarterback while meeting with writers who regularly cover the team Thursday for the first time since the Jets finished 8-8 and failed to make the playoffs.

But, he also wouldn't rule out the possibility of pursuing a veteran such as Peyton Manning if the Indianapolis Colts star became available.

"I'm not going to ever tell you guys what we may or may not do," Johnson said in a 30-minute far-ranging interview.

"Our job, and my job for the fans, is to take this team to the very top level, and I've said that from the beginning. And I have a lot of confidence that we can do it. So, we're going to look at everything. We're going to look at every possibility, and that's what you'd want us to do."

Johnson said "there's no such thing as 100 percent" when asked if Sanchez would definitely be the starter next season.

"Barring whatever," he said, "yes."

That "whatever" could be the status of Manning, who missed the season after a few operations on his neck.

He's still a highly unlikely possibility for Rex Ryan's Jets since he's still under contract to the Colts, is 10 years older than the 25-year-old Sanchez and would be a tough fit financially for New York.

But the fact Johnson didn't completely slam the door on the idea of Manning joining his brother Eli as quarterbacks in New York could keep the rumor mill spinning in the offseason. Johnson did sound later as though the franchise is thinking about Sanchez for the long term.

"With Mark, you have a 25-year-old quarterback that you can develop," he said. "You can have a quarterback for 10 years with a guy like this. These guys are not available everyday.

"We have a lot of confidence in Mark. We think he's our guy. We're blessed that we have a guy that we feel can climb the ladder and he can do everything. He's got the work ethic and has all the ingredients in place to be a great quarterback."

Johnson indicated that new offensive coordinator Tony Sparano taking the reins from the departed Brian Schottenheimer could help Sanchez. Sparano, hired last week, said he wanted the offense to be "explosive," but also wanted a focus on running the ball ? as the Jets did in Sanchez's first two seasons.

"My feeling is that Mark is the kind of guy that will learn from this and get better," Johnson said. "We are going to try to make the offense maybe a little bit more suitable to what Mark's development is."

He added that the blame shouldn't be placed all on Sanchez, despite his lousy finish, but agreed that he might need a backup who could help challenge him.

"He's got to have somebody breathing on his back, yeah, I think you could argue that," Johnson said.

Johnson also is "concerned but I'm confident" that the fractured relationship between Sanchez and wide receiver Santonio Holmes can be mended.

Holmes was highly critical of the offensive line during the season and clearly had some tension with his quarterback.

It all came to a head in the season finale at Miami when Holmes was benched late in the game after arguing with teammates in the huddle.

"They've won a lot of games together and one is good for the other," Johnson said. "Santonio makes the quarterback a lot better and vice versa. So they have a good reason to iron this thing out and I think they can do it."

Johnson acknowledged that he might sit down with the two, either individually or together, at some point. While he added that Holmes will definitely be back, the Jets are tied to Holmes financially after they gave him a five-year, $45 million deal last offseason ? something the owner doesn't regret.

"He may be one of the best players we've ever had here," said Johnson said, who added that he was troubled by the perception that Holmes quit on the team as the season ended.

"I have a good relationship with Santonio," Johnson said. "He's going to have a fresh start this year and I think he'll take advantage of it. He knows it's important to him, it's important to us."

Johnson also disputed LaDainian Tomlinson's claim on Showtime's "Inside The NFL" that the Jets had the worst locker room tension he has ever seen, saying the running back might have overstated things.

"I didn't feel a toxicity in the locker room," Johnson said, adding that he'll talk to Tomlinson to clarify his statements.

"I hear what LaDainian (is saying). I respect LaDainian at the highest level, but I don't think the whole locker room was toxic. I think there were clearly a few players that had conflicts. ... Would you love to have total harmony? Maybe. But maybe it's good to have a little bit of disharmony also. But they have to care about each other."

Ryan has said that he felt he never really had the pulse of the locker room, and many ? including Tomlinson ? think the coach's brash approach, along with general manager Mike Tannenbaum, set the tone for what took place. Johnson supported the aggressive style, saying it is more of a positive when building a team.

"The great thing about Rex as opposed to people not like Rex, is that he has a very healthy ego," Johnson added. "It's very healthy. He realizes that being a great coach requires admitting mistakes perhaps or changing or altering his style or management style or learning that we don't all grow up being great managers at age 40 whatever he is. Sometimes, it takes you a little longer and in most cases it does to be a good manager."

Johnson has spoken to Ryan about how the season unfolded, and believes the coach will keep improving.

"I think he realizes that he is the head coach," Johnson said. "He's a savant defensive guy, but he is a head coach. He has responsibility for the whole room and I think he will be a lot more involved and take a bit of a different management approach to that, I would suspect. Not because I told him to, but because I think he has figured this out."
