To begin trademark registration in the UK you have to apply to the IPO or Intellectual Property Office. Complete your TM3 form, which can be done online or submitted by mail. You will need to include the fact sheet and appropriate fee with your trademark registration. The fee schedule can be found online.

There are discounts that can be applied when your trademark registration is for more than one class there are also discounts available when you apply online and pay the fee at the time of registering. You can pick between the two services:

Right Start Service ? you pay half of the normal fees. The Intellectual Property Office will then review your trademark registration application and make sure you meet the requirements for trademark registration. They will then issue their report. You pay the balance of the fees when you decide to proceed with your application. If you do not proceed you do not pay the balance of the fees.

Standard Service ? You submit your trademark registration application to the Intellectual Property Office and you pay all applicable fees.

When applying for a Trademark with the IPO you must:

- Conduct a Search ? make sure that the same trademark has not been applied for or registered by someone else for the same or similar trademarks.

- Make Sure it?s Right ? You cannot change your trademark once your application is submitted so double check to make sure everything is right.

- List all Goods & Services ? You cannot add later so make sure you include all goods & services you want covered in your initial application.

The Process Once Your Application is Received

Once your trademark registration application has been received the Intellectual Property Office will review your application. This generally occurs within 30 days but can take longer. If your trademark registration application is accepted the Trade Marks Journal will publish it. If there are no objections 60 days later your trademark is registered and your certificate of registration is issued. This registration is valid for 10 years and can be renewed for a further 10 years.

How to Defend Your Trademark

If you trade using a distinctive slogan, logo, or other marking you have the right to defend your mark. A trademark can be an important asset to your business and an integral intellectual property, so you should be prepared to protect it.

It is highly recommended that you have the aid of an experienced trademark attorney and seek their legal expertise, as this type of legal battle is complex. The outcome is also very important to the health of your business.

Where You Can Get Assistance

Searching to find out whether your trademark is previously registered and applying for a trademark is not an easy process. It?s complex and mistakes occur more often than you might think. It?s a good idea to have a patent or trademark attorney give you professional advice so as not to make any mistakes.

Trademarks are classified as intellectual property and they are important to many businesses. Make sure you take the time to protect your trademarks before it?s too late.
